1. DEFINITIONS

4. “Receiver” refers to the user who accesses the website and makes the payment for purchasing food from the platform
5. “Service” or “Services” refers to the Services as defined below offered through the website.
6. “User Account” shall mean an electronic account opened by the user with the Platform to avail services offered through the Website

2. ACCEPTANCE OF TERMS

By using this site, you agree and accept the Terms and Conditions of use. You also agree and accept the Terms and Conditions by registering for the Services and/or making any payment as required under the Terms and Conditions of the Services. You may also accept the Terms and Conditions by clicking to accept or agree to the Terms and Conditions where and if this option is made available to you by Harigon in the user interface.

3. YOUR ACCOUNT
1. You are solely responsible for maintaining the confidentiality of your username and password.
2. Harigon may refuse to open an account or sell products to any person at any time in its sole discretion.
3. Harigon retains the right to terminate your account at our discretion, for any reason. Should there be outstanding product orders placed on www.harigon.com.au , we will provide a refund or complete delivery of the order.

4. PAYMENT
1. All the purchases from this website shall be governed by our terms and conditions.
2. Payment is due at the time order is confirmed. If no payment is made, or payment is declined, then we reserve the right to cancel your order.
3. If you make an Order for buying food from our platform. At the time ordering, while providing your details you must be careful and warrant that the details provided are true and accurate. 
4. By Harigon offering the Services to you, you agree that: 
1. You are sole liable for confirming that the details entered by you in respect of your order. We shall not be liable in the event of late delivery or non-delivery of your order by reason of wrong/incorrect delivery details entered by you on the Website
2. All payments made during your use of the Services are made using Stripe. In using the Website, the Services or when making any payment in relation to your use of the Services, you warrant that you have read, understood, and agree to be bound by the Stripe terms and conditions which are available on their Website and Mobile Application.
3. Any order to purchase a food that you place with us is subject to acceptance by us. When you make your order online, we will provide you an email to confirm that we have received it.
4. If there is an error in the order confirmation, please contact us immediately by email at help@harigon.com.au
5. We are happy to support you if there is any issue you can contact our back-office team for any inquiry or problem.

5. FEES & CHARGES
1. Due to market conditions, prices listed on the website are subject to change without notice. However, the current prices will be published on the website and available before you place an order. If a price change affects your standing order or an order that you have made in advance, we will notify you via phone, email or SMS informing you of the updated price. It will then be your responsibility to amend your order as desired.

6. DELIVERY
1. To purchase goods from Harigon, the delivery address which you nominate will need to be within our delivery zone. Please ensure your delivery address is correct, as orders that are located outside of our delivery zone will not be processed.
2. Unattended deliveries. Harigon is not responsible for any damage or theft to your order when left in the designated area that you have specified. We recommend that your delivery is brought inside and stored away as soon as possible.
3. At the time of delivery, your order will be at an appropriate temperate to ensure it is as fresh as humanly possible. Whilst Harigon will make every effort to ensure your product remains at a suitable temperate after delivery (i.e., with cooler bags and cooling devices), we are no longer responsible for your order once it has been delivered.
4. We accept that in the event of your order arriving damaged due to our own transport, we will replace the goods free of charge or give you a credit on your next order.

5. Delivery time may take up to 7 business days.

7. LIMITED WARRANTY
1. We do not warrant the accuracy of any of the information contained within the product list nor on the labels on goods delivered. We recommend that you read the labels on goods supplied carefully before they are consumed.
2. All images used on our website are representations for your information only and are not necessarily true images of that product.
3. We do not provide any warranty or guarantee that the service descriptions are accurate, complete, reliable, current, or error-free.

8. OUT OF STOCK, RETURNS AND REFUNDS
1. If your product is damaged or short stocked, we will issue a refund. Otherwise, our products and services are non-refundable.
2. All Goods and Services are non-refundable unless in accordance with these terms or where required by law or otherwise identified in any refund policy published by Harigon in existence from time to time.
3. To the extent permitted by law, if Harigon is found to be liable to you, our liability shall be limited to a refund of amounts paid by you to Harigon a replacement of the goods or services supplied, or re-performance of the services supplied.
4. Harigon will manage requests for refunds in accordance with the Harigon Refund Policy and the Australian Consumer Law
5. Harigon will not offer a refund or return where you change your mind in respect of any purchase of a Product
6. If there are items missing from your delivery, please contact us as soon as possible. We will fix the problem for you by either crediting the amount to your account or re-delivering the product.
7. If you are not satisfied with the quality of a product, we want to hear about it. Please contact us and we will aim to fix it for you.
8. If an item is out of stock, we will endeavour to inform you about it.

9. LIMITATION OF LIABILITY
1. Harigon’s maximum liability to you for products purchased from our website shall be limited to the refund of the purchase price you have paid for the products. Harigon will not be liable for any property damage, indirect, incidental, punitive, or special damages, however caused, whether for breach of warranty, contract, tort (including negligence), strict liability or otherwise except which it is unlawful to exclude.

10. MODIFICATIONS TO TERMS AND CONDITIONS
1. Harigon may, at any time, modify this agreement or any of these terms and conditions. Any modified agreement will be available online and will be effective immediately upon posting to the website.
2. You agree to assume responsibility for periodically reviewing this agreement.
3. By continuing to use our service, you agree to be bound by the agreement as so amended.

15. PROMOTIONS
1. All discounts, vouchers or codes only apply to first orders for new customers of Harigon unless otherwise stated.
2. All promotion validity dates are specified on the adverts, coupons, emails, or leaflets
3. Discounts, vouchers, or codes are not to be used in conjunction with any other offers, discounts, vouchers, or codes.
4. Only one discount, voucher or code can be used per order and each discount, voucher or code can only be used once per household.
5. Discounts, vouchers, or codes cannot be exchanged for cash or any other alternatives and have no monetary value.
6. All discounts, vouchers and codes can only be used on one order, any remaining credit from that discount, voucher or code cannot be carried forward to any additional or subsequent orders.
